2. Definitions
In these terms and conditions the following definitions apply:
- Lashvie Cosmetics: Lashvie Cosmetics V.O.F., established in Vriezenveen.
- Customer: any natural person acting for purposes outside their trade or profession.
- Agreement: any agreement concluded between Lashvie Cosmetics and the customer through the website.
3. Applicability
1. These terms and conditions apply to all offers, orders and agreements between Lashvie Cosmetics and consumers.
2. Deviations from these terms are only valid if agreed in writing.
3. If any provision of these terms is wholly or partly invalid, the remaining provisions remain in full force.
4. Products
1. Lashvie Cosmetics sells, among other things, press-on lashes, tweezers, lash curlers and related beauty products.
2. Product images and descriptions are presented as accurately as possible. Obvious errors, mistakes or misprints do not bind Lashvie Cosmetics.
5. Conclusion of the agreement
1. The agreement is concluded the moment the customer places an order and Lashvie Cosmetics confirms that order.
2. Lashvie Cosmetics reserves the right to refuse an order if there is a justified reason to do so.
6. Prices and payment
1. All stated prices include VAT, unless expressly stated otherwise.
2. Any shipping costs are clearly displayed before the order is completed.
3. Payment is made through the payment methods offered on the website, which are shown during checkout. We accept, among others: Credit Card, iDEAL.
4. Products are shipped after payment has been successfully processed, unless another payment method provides otherwise.
7. Delivery
1. Lashvie Cosmetics delivers within the Netherlands and other countries within the European Union.
2. Delivery takes place via carriers such as PostNL and DHL.
3. Stated delivery times are indicative. Exceeding a delivery time does not automatically entitle the customer to compensation or dissolution of the agreement, unless provided otherwise by law.
4. The risk of damage to or loss of products remains with Lashvie Cosmetics until the products have been delivered to the customer or a third party designated by the customer.
8. Right of withdrawal
1. The consumer has the right to withdraw from the agreement without giving reasons within 14 days of receiving the product.
2. To exercise the right of withdrawal, the consumer must notify Lashvie Cosmetics unambiguously within this period.
3. After withdrawal, the product must be returned within 14 days.
4. The consumer bears the direct cost of returning, unless stated otherwise. See also our return policy.
9. Exclusion of the right of withdrawal
1. For reasons of health protection and hygiene, sealed products cannot be returned once the seal has been broken after delivery.
2. This exception applies only to the extent permitted by law.
3. The exclusion of the right of withdrawal does not affect consumers' statutory rights in the case of wrongly delivered or defective products.
10. Statutory warranty and conformity
1. Lashvie Cosmetics guarantees that the delivered products comply with the agreement and the reasonable expectations the consumer may have of them.
2. The consumer is entitled to the statutory warranty as laid down in the applicable consumer law.
3. If a product does not comply with the agreement, Lashvie Cosmetics will provide repair, replacement, price reduction or refund in accordance with its statutory obligations.
11. Complaints
1. The consumer must report complaints about products or services as soon as possible after discovery.
2. Complaints can be submitted via lashvie.cosmetics@gmail.com.
3. Lashvie Cosmetics aims to respond substantively to complaints within 14 days of receipt.
12. Liability
1. Lashvie Cosmetics is liable only for direct damage resulting from an attributable shortcoming.
2. To the extent permitted by law, liability is limited to the amount paid for the relevant order.
3. Nothing in these terms limits statutory consumer rights or liability that may not be excluded by law.
13. Force majeure
1. Lashvie Cosmetics is not liable for delays or shortcomings resulting from force majeure.
2. Force majeure includes, among other things: carrier disruptions, internet outages, government measures, natural disasters, pandemics and other circumstances beyond the reasonable control of Lashvie Cosmetics.
14. Intellectual property
1. All intellectual property rights relating to the website, product photos, texts, designs, logos, trade names and other content belong to Lashvie Cosmetics or its licensors.
2. Without prior written permission, these materials may not be copied, distributed or otherwise used.
15. Privacy
1. Lashvie Cosmetics processes personal data in accordance with its Privacy Policy.
2. The Privacy Policy is available on the Lashvie Cosmetics website.
16. Applicable law and disputes
1. Dutch law applies to all agreements between Lashvie Cosmetics and the consumer.
2. If the consumer is resident in another member state of the European Union, the mandatory consumer rights of the country of residence remain applicable to the extent that they offer more protection.
3. Disputes are submitted to the competent court in accordance with the applicable law.
17. Final provisions
1. If any provision of these terms is invalid or unenforceable, the remaining provisions remain in full force.
2. Lashvie Cosmetics reserves the right to amend these terms and conditions. The most recent version is published on the website.

2. Definitions
In these terms and conditions the following definitions apply:
- Lashvie Cosmetics: Lashvie Cosmetics V.O.F..
- Business customer: any natural person or legal entity acting in the course of a profession or business.
- Reseller: a business customer who purchases products from Lashvie Cosmetics for resale.
- Agreement: any agreement between Lashvie Cosmetics and a business customer.
3. Applicability
1. These terms apply to all quotations, offers, orders, deliveries and agreements between Lashvie Cosmetics and business customers.
2. The business customer's general terms are expressly rejected.
3. Deviations from these terms are only valid if confirmed in writing by Lashvie Cosmetics.
4. Quotations and offers
1. All quotations and offers are without obligation.
2. Obvious errors, typing errors, pricing errors or mistakes do not bind Lashvie Cosmetics.
3. An agreement is only concluded after Lashvie Cosmetics has confirmed an order.
5. Minimum order quantity
1. A minimum order quantity applies to wholesale orders:
- 5 boxes per model of press-on lashes;
- 5 boxes of tweezers;
- 5 boxes of lash curlers.
2. Lashvie Cosmetics reserves the right to change minimum order quantities or minimum order values.
3. Orders that do not meet the minimum order requirements may be refused.
6. Products and resale
1. The business customer may resell original Lashvie Cosmetics products within the European Union.
2. Products may only be sold in their original condition and original packaging.
3. The business customer will not provide misleading, incorrect or harmful information about the products.
4. Selling products under a different brand name is not permitted without prior written permission from Lashvie Cosmetics.
7. Prices and payment
1. All wholesale prices are stated exclusive of VAT, unless expressly stated otherwise.
2. Any shipping costs are stated separately.
3. All orders must be paid in full in advance.
4. Products are only shipped after full payment has been received.
5. Lashvie Cosmetics reserves the right to refuse or cancel an order if payment is not made.
8. Delivery
1. Delivery takes place within the Netherlands and other countries within the European Union.
2. Delivery takes place via carriers such as PostNL or DHL.
3. Stated delivery times are indicative and do not constitute a strict deadline.
4. Exceeding a delivery time does not give rise to any right to compensation, dissolution or suspension of payment obligations.
5. The risk of loss or damage passes to the business customer at the moment of delivery.
9. Retention of title
1. All delivered products remain the property of Lashvie Cosmetics until full payment has been made.
2. The business customer may not pledge or otherwise encumber products subject to retention of title.
3. If the business customer fails to meet its obligations, Lashvie Cosmetics is entitled to reclaim the products.
10. Returns, cancellations and complaints
1. The statutory right of withdrawal does not apply to business customers.
2. Delivered products cannot be returned or exchanged, unless:
- a product was received damaged;
- the wrong product was delivered;
- there is a demonstrable manufacturing defect.
3. Complaints must be reported in writing within 5 working days of receipt via lashvie.cosmetics@gmail.com.
4. When making a complaint, the business customer must provide clear photos and relevant information.
5. No products may be returned without prior written permission from Lashvie Cosmetics.
6. Orders already confirmed cannot be cancelled free of charge.
11. Warranty
1. Lashvie Cosmetics guarantees that the delivered products comply with the agreed specifications.
2. The warranty lapses if products have been incorrectly stored, handled, modified or used.
3. If a complaint is found to be justified, Lashvie Cosmetics will, at its own discretion:
- replace the product;
- provide a credit;
- refund the purchase amount.
12. Liability
1. Lashvie Cosmetics is liable only for direct damage that is the direct result of an attributable shortcoming.
2. Any liability is limited to the invoice amount of the relevant delivery.
3. Liability for indirect damage, consequential loss, lost profit, loss of turnover, reputational damage and missed savings is excluded.
4. The limitations in this article do not apply to damage caused by intent or deliberate recklessness on the part of Lashvie Cosmetics.
13. Force majeure
1. Lashvie Cosmetics is not liable for delays or shortcomings resulting from force majeure.
2. Force majeure includes, among other things:
- transport problems;
- disruptions at suppliers;
- internet or system outages;
- government measures;
- pandemics;
- natural disasters;
- strikes;
- other circumstances beyond the reasonable control of Lashvie Cosmetics.
3. During force majeure, obligations may be suspended for as long as the situation continues.
14. Intellectual property
1. All intellectual property rights relating to the Lashvie Cosmetics brand name, logos, product photos, packaging, designs, texts and marketing materials remain the property of Lashvie Cosmetics.
2. Without prior written permission, these materials may not be copied, modified, distributed or used outside normal sales activities.
3. The business customer may only use original product photos and marketing materials if Lashvie Cosmetics has given permission to do so.
15. Confidentiality
1. Business customers treat confidential business information strictly confidentially.
2. Confidential information includes, among other things, price arrangements, margins, supplier information, business strategies and other non-public business information.
3. This obligation remains in force after the end of the business relationship.
16. Termination of the cooperation
1. Lashvie Cosmetics may immediately terminate a business relationship if:
- payment obligations are not met;
- there is fraud or abuse;
- the reputation or brand name of Lashvie Cosmetics is harmed;
- these terms are seriously breached.
2. Outstanding payment obligations remain fully due.
17. Applicable law and disputes
1. Dutch law applies exclusively to all agreements between Lashvie Cosmetics and business customers.
2. The applicability of the Vienna Sales Convention (CISG) is expressly excluded.
3. Disputes are submitted exclusively to the competent court in the district in which Lashvie Cosmetics is established, unless mandatory law provides otherwise.
18. Final provisions
1. If any provision of these terms is wholly or partly invalid, the remaining provisions remain in full force.
2. Lashvie Cosmetics reserves the right to amend these terms and conditions.
3. The most recent version of these terms is provided on request or made available via the website.
